- The Era of Change: What led to the amendments introduced by the Insurance Act 2015?
- The Duty of Fair Presentation from a practical perspective.
- What is considered to be ‘a material circumstance’?
- What does it mean for an insured? The duties and expectations of an insured.
- What does it mean for an insurance broker? The duties and expectations of an insurance broker.
- What does it mean for an insurer / underwriter? The duties and expectations of an insurer / underwriter.
- Discussion of common pitfalls and misunderstandings.
- Remedies available to an insurer based on a breach of the Duty of Fair Presentation.
What will I achieve by attending the workshop?
By the end of the workshop, participants will be able to:
- Demonstrate an understanding of the historical context to the doctrines of misrepresentation and non-disclosure.
- Learn about the reasons for and the practical effects of the changes introduced by the Insurance Act 2015.
- Identify the duties of the insured, broker and insurer from a practical industry perspective.
- Demonstrate a practical understanding of what is considered to be a ‘material circumstance’.
- Become aware of common pitfalls and misunderstandings.
- Explain the remedies available to an insurer as a result of material misrepresentation and non-disclosure.
