• Historical Development with regard to the area of Misrepresentation and Non-Disclosure. MIA 1906.
• The Era of Change: What led to the amendments introduced by the Insurance Act 2015?
• The Duty of Fair Presentation from a practical perspective.
• What is considered to be ‘a material circumstance’? 
• What does it mean for an insured? The duties and expectations of an insured.
• What does it mean for an insurance broker? The duties and expectations of an insurance broker.
• What does it mean for an insurer / underwriter? The duties and expectations of an insurer / underwriter.
• Discussion of common pitfalls and misunderstandings.
• Remedies available to an insurer based on a breach of the Duty of Fair Presentation.

What will I achieve by attending the workshop? 

By the end of the workshop, participants will be able to: 

• Demonstrate an understanding of the historical context to the doctrines of misrepresentation and non-disclosure.
• Learn about the reasons for and the practical effects of the changes introduced by the Insurance Act 2015.
• Identify the duties of the insured, broker and insurer from a practical industry perspective.
• Demonstrate a practical understanding of what is considered to be a ‘material circumstance’.
• Become aware of common pitfalls and misunderstandings.
• Explain the remedies available to an insurer as a result of material misrepresentation and non-disclosure.
